Nationwide suit

Workday must face a nationwide age-bias case over its AI screening

Employers use Workday's platform to collect and screen job applications. A job seeker alleges its AI recommendation system, which can score, sort, rank or screen applicants, discriminates against people over 40. He says he was rejected for every one of more than 100 jobs he sought through Workday since 2017. Four other applicants over 40 say they were rejected almost every time. On May 16, 2025, Judge Rita Lin let the age claim proceed as a nationwide collective action. It covers applicants 40 and over, since September 2020, who were denied recommendations. Workday suggested the group could number in the hundreds of millions. Workday says its tools don't make hiring decisions. The case is ongoing.
